Terms & Conditions — Donations (Republic of Austria)

1. Payment Provider — Stripe

All payments, payment methods, credit-card data, SEPA mandates, recurring authorisations and refunds on the Donora platform are processed exclusively by Stripe Payments Europe Ltd. (Ireland) and its affiliates (“Stripe”) as an independent payment service provider licensed under the EU Payment Services Directive (PSD2) and the Austrian Payment Services Act 2018 (Zahlungsdienstegesetz, ZaDiG 2018). Donora GmbH does not store full card numbers, does not hold your funds and does not act as a payment institution. Card data is transmitted directly to Stripe via PCI-DSS-compliant elements; Donora only receives a payment-method token and the resulting charge result.

Use of the payment service is additionally governed by the Stripe Services Agreement and the Stripe Privacy Policy.

2. KYC, Anti-Money-Laundering and Sanctions Screening

Identity verification (Know-Your-Customer, KYC) and anti-money- laundering screening (Geldwäscheabwehr under the Austrian Finanzmarkt-Geldwäschegesetz, FM-GwG, and Directive (EU) 2015/849) related to the payment transaction are carried out by Stripe as the responsible financial institution. Sanctions and watchlist screening on the payment side is likewise performed by Stripe. Donora may suspend a donation or account where Stripe rejects, holds or refunds a payment for compliance reasons.

3. Fees — Donor Side

When you make a donation, the following fees may be displayed and deducted transparently before payment is confirmed:

  • Donora processing fee — a small platform fee charged by Donora GmbH for operating the donation flow, receipt generation, donor support and BMF reporting. Shown separately in the app.
  • Stripe payment-gateway fee — the fee charged by Stripe for processing the card / SEPA / wallet transaction. This fee is not retained by Donora; it is forwarded in full to Stripe.

If you choose to cover the fees, the full nominal donation amount reaches the receiving organisation; otherwise the fees are deducted from the donation amount. The exact split is shown on the donation confirmation screen and on the PDF receipt.

4. Refunds

Donations are generally final. Refunds may be issued in exceptional circumstances (duplicate charges, processing errors, fraud, sanctions hit) at Donora's discretion and are executed via Stripe, in line with Austrian consumer protection standards (KSchG). Refunded amounts are reversed at the BMF where they had already been reported.

5. Donor Identity and Data Retention

For fraud prevention, receipt generation, and regulatory compliance you consent to the collection of your legal name, address, IP address, and user-agent at the moment of donation. Tax-relevant records (donation receipts, fee breakdowns) are retained for seven years in accordance with § 132 para. 1 of the Austrian Federal Fiscal Code (Bundesabgabenordnung, BAO).

6. Tax Deductibility

Donations to organisations listed as tax-privileged under § 4a of the Austrian Income Tax Act (Einkommensteuergesetz 1988, EStG 1988) are tax-deductible up to 10 % of the total amount of taxable income. From 2017 onwards, personal donations by natural persons are by default transmitted automatically to the Austrian tax authority (BMF) via the Automatische Datenübermittlung under § 18 (8) EStG 1988.

7. Opt-out of Automatic Reporting (§ 18 (8) EStG 1988)

You may opt out of the automatic reporting of your donation to the BMF during the donation flow, before payment is confirmed. If you opt out:

  • Your donation is not transmitted to FinanzOnline.
  • Your legal name and date of birth are not required for the donation.
  • The PDF receipt remains available; you must keep it yourself for paper-based deduction in your annual tax assessment.
  • You may revoke your opt-out at any later time by re-enabling the automatic reporting on a subsequent donation.

Company donations (donor type "company" with a UID) are never reported via the automatic transmission — they qualify as Betriebsausgabe under § 4a EStG 1988 and are deducted directly in the company's tax filing.

8. Recurring Donations — Lifecycle

When you set up a recurring donation, you grant Stripe a SEPA mandate or card authorisation to charge the chosen amount on the chosen interval (e.g. monthly, yearly).

  • The recurring donation remains active and is charged automatically on every interval until you actively pause or cancel it in the Donora app.
  • You can pause the schedule at any time — no further charges occur until you resume.
  • You can cancel the schedule at any time — the mandate is then revoked at Stripe and no further charges occur.
  • Failed charges are retried according to Stripe's standard dunning schedule; if all retries fail, the schedule is automatically paused and you are notified by email.
  • Your right of withdrawal under the Fern- und Auswärtsgeschäfte- Gesetz (FAGG) and your SEPA refund rights remain unaffected where applicable.

9. Governing Law and Jurisdiction

These terms are governed by Austrian law. Place of jurisdiction is Vienna (Wien), subject to the mandatory protective jurisdiction for consumers under § 14 KSchG.
